Which is your case?
Each one of the following cases require a different solution.
1. Property in a residential area. You should be able to live in it or rent it as a whole.
- 1A. Usual residence or long-term rented property. This is the only case not requiring special legal advice beyond the usual help during the buying process.
- 2B. Partial rent. Depending on the case, renting just some rooms could not be allowed, thus requiring legal assistance.
2. Property in a tourist area. In principle, it’s not possible to live in it, or to rent it outside the hotel bussiness, even if it is not being well managed.
- 2A. Tourist complexes with a single accommodation business operating the apartments (“unidad de explotación”). It’s the most common reality in Maspalomas, Playa del Inglés, Puerto Rico, Puerto de Mogán and other resorts. This situation always requires specialized legal assistance.
- 2B. Tourist complexes without such a working business (i.e., it went bankrupt). Apart from knowing the regulations, it is quite necessary to investigate the plans and procedures of the homeowners’ association, before investing.
